Philadelphia Birth Injury Lawyer Jim Beasley Jr., MD, JD used his medical and legal knowledge to successfully evaluate a birth injury case that left a child with Cerebral Palsy, spastic diplasia, seizures and developmental delays.
It was discovered that when the mother presented to the hospital in labor, the baby's heart rate was higher than normal. In addition, the mother's blood work showed an elevated white blood cell count that usually means an infection is present. A few hours into the labor, it was noted that there was meconium staining of the amniotic fluid. Meconium stained fluid could mean that a baby is in distress or not tolerating the labor.
As the labor progressed, the baby's heart rate continued to increase and the fetal monitor strips, or the baby monitor, were showing signs that the baby was starting to get tired or developing distress. Hours passed. Mom then developed a fever and the baby was showing more signs of fetal distress on the fetal monitor strips. The baby then developed deep variable decelerations indicating that the baby was in danger and not getting the much needed blood flow and nutrients. It was at that time that the doctors decided to perform a C-section.
Unfortunately, the baby was born with lower than normal APGAR scores and required oxygen after birth. The pathology report of the placenta showed severe chorioamnionitis and funisitis, which means that there was an infection that developed after the water or amniotic fluid sac broke.
During labor, the only way a baby can talk to the doctors is through the fetal monitor strips or baby monitor. Obstetrician's, Nurse Midwives, and nurses need to pay attention to what the baby is telling them. They need to watch and respond to the changes in the fetal monitor strips. This baby was trying to tell everyone there was an infection, but no one listened until it was too late.
Here at the Philadelphia Beasley baby injury law firm, Jim Beasley Jr.’s medical and fetal monitor strip knowledge allowed them to easily spot problems with the labor and the baby. During mediation, attorneys Jim Beasley Jr. and Dion Rassias were able to successfully present the facts of the case and their combined knowledge led to the multi-million dollar settlement on behalf of the brain injured baby.
